End-User License Agreement

This agreement is between you and Bespoke Byte, LLC ("we", "us"), a limited liability company registered in the State of Wyoming, United States. It governs your use of the Katami app for macOS, including its updates and the on-device models it downloads (together, the "Software"). By installing or using the Software you agree to it.
We have tried to write it plainly. How Your License Works explains the same model in everyday terms.
If you are a consumer — buying for yourself rather than for a business — you have rights under the law of the country you live in that no contract can take away. Nothing in this agreement limits them, and where it conflicts with them, they win.
1. Your license
When you buy a license, we grant you a perpetual, non-exclusive, non-transferable license to install and use the Software:
- one person — the license holder;
- on up to two Macs that you use at a time;
- for every version released during your update period, each of which you may keep using forever;
- for any purpose, personal or professional, including paid work.
Your update period is the 12 months from the day you buy your license. Every release we publish in it is included, new features as well as fixes.
The license does not expire. When your update period ends, the Software keeps working, and every version released during it stays licensed to you; newer versions are simply not offered to you. You may buy another 12 months of updates at any time, for $39 USD plus any tax. If your update period has already ended, the new one starts on the day you renew. You may renew as often as you like, or not at all.
A complimentary license, one we grant free of charge, has no update period: it includes every release, always.
A license bought before the update period was introduced keeps every release of Katami 1 (every version numbered 1.x), under the terms it was bought under. Nothing in this section reduces it or asks anything new of its holder.
If we ever shut down our licensing service, we will first release a final update of the Software that runs without it, so the version you own keeps working.
2. Activation and what the Software sends
The Software is activated by signing in, which links the Mac to your license. To keep that link working, the Software contacts our licensing service when it can — at launch and about once a day — and sends a hashed identifier for the Mac, the Mac's name, the app version and a sign-in token. It also checks for updates and model downloads, and asks Apple Maps for the place names of photos that carry GPS coordinates, sending Apple those coordinates only.
That is everything it sends on its own. It never sends your photographs, or anything derived from them, to us. The Privacy Policy is the full account.
You can move your license between Macs by unlinking one in the License Manager.
3. Working offline
The Software keeps working when it cannot reach us, for as long as that lasts. It does not lock because a check failed. It stops working as a licensed copy only when our service answers that the license was refunded, charged back or revoked under section 11, or that the Mac was unlinked.
4. Updates
We provide every update released during your update period free of charge, and every update, always, for a complimentary license. The Software checks for them about once a day and tells you when one is available; it downloads and installs an update only when you choose to. Every update is signed, so the Software accepts only updates we published.
An update may change or remove a feature. We will not use an update to take away a core capability of a version you are licensed to use, and we will say in the release notes when a feature changes meaningfully.
5. Beta versions
We may offer pre-release versions to license holders. Betas are provided to test, are unfinished, and may lose or damage data. They are provided "as is" even where section 12 would otherwise give you more.
6. Your photographs and your library
Your photographs are yours, and they stay on your Mac. The Software reads and analyses them locally. We claim no rights in them, and never receive them.
The Software can write changes into your files when you ask it to — for
example, a new location or a rotation. Before it changes a file for the first
time, it keeps a copy of the original in ~/Pictures/Katami.katami. Even so,
keep your own backups: no software, ours included, is a substitute for one.
7. On-device intelligence
The Software uses machine-learning models on your Mac to detect and group faces, recognise the people you name, read text, write captions, and make estimates such as whether a photo may be sensitive or a person's apparent gender. These are estimates, and they can be wrong. They exist to help you organise your own library. Do not rely on them to make decisions about people.
The results are created on your Mac and stay there. If your library contains other people, what you do with it is up to you, as with any photo software; we never receive it.
8. What you may not do
You may not:
- sell, rent, lend, share or sublicense your license, or give others use of it;
- remove or bypass the license check, or help someone else to;
- extract the models or other components the Software downloads to use them outside the Software;
- reverse engineer the Software, except where the law lets you do so despite this restriction.
9. Third-party components
The Software includes open-source components and model weights licensed by others, listed with their licenses in the app (Katami ▸ About Katami). Those licenses govern those components, and nothing in this agreement restricts rights they give you. Place names and maps come from Apple Maps, under Apple's terms.
10. Feedback and problem reports
If you send us ideas or suggestions, we may use them freely, without owing you anything for them. Problem reports — and any pictures you attach — remain yours; we use them only to understand and fix the problem, as the Privacy Policy describes.
11. Refunds, revocation and termination
You can ask for a refund within 14 days under the Refund Policy. A refund or a chargeback ends the license. The same 14 days apply to a renewal of your update period; refunding a renewal ends the 12 months of updates it bought, not the license.
We may revoke a license that was obtained fraudulently or used in material breach of this agreement — for example, a license key shared publicly. Where the breach can be put right, we will tell you and give you the chance to first.
You may end this agreement at any time by deleting the Software. When it ends, you must stop using the Software. Sections 6, 10, 12, 13 and 15 survive.
12. Warranty
We build the Software carefully, and we fix what is broken. Beyond that, and to the extent the law allows, it is provided "as is": we do not promise it will be free of errors, run without interruption, or suit your particular purpose.
If you are a consumer, you have statutory rights about the quality of digital content — for example, that it matches its description and is fit for purpose. This section does not affect them.
13. Liability
To the extent the law allows, our total liability to you arising out of the Software is limited to the amount you paid for your license, and we are not liable for indirect or consequential loss, such as lost profits or lost data.
These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct.
14. Export
You may not use or export the Software in violation of US export laws or sanctions.
15. Governing law
This agreement is governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory law of the country you live in, and you may bring a claim in its courts.
Please email us first if something has gone wrong. Nearly everything is settled faster that way.
16. Changes to this agreement
We may update this agreement for new releases. A change applies to releases published after it, and never takes away what you already bought: every version you are licensed to use stays under the terms you bought it under. We will note material changes in the release notes.
17. The whole agreement
This agreement, the Terms of Service and the Refund Policy are the whole agreement about the Software. If a part of it cannot be enforced, the rest still applies. Not enforcing a part of it is not a waiver.
